Revised MCA code of practice ‘still under discussion’ two years after consultation on changes

The MCA code provides guidance on how social workers, NHS professionals, advocates, other relevant care staff, Court of Protection-appointed deputies and people holding power of attorney should apply the act in practice. Whately sidestepped the question. The code has not been revised since its publication in 2007.

A senior adults’ practitioner has lost his bid to stop Social Work England obtaining a family court judgment that found he abused his ex-partner. Though family court proceedings are generally held in private, courts may permit disclosure of information, under rule 12.73 of the Family Procedure Rules 2010.
